Driving under the influence of alcohol is the most commonly committed crime in California.  A person over the age of 21 who drives a motor vehicle with a blood alcohol content (BAC) of .08% or higher can be arrested for driving under the influence (Vehicle Code Section 23152b).  Anyone with any amount of alcohol in their system can be arrested for driving under the influence, but usually is not charged.  A person under the age of 21, but over 18 can be arrested for driving under the influence with a BAC of .05% (Vehicle Code Section 23140).

Please note, if you have been arrested for a DUI or DWI, or even a “wet and reckless”, you must call the Department of Motor Vehicles within 10 days of your arrest to request a hearing or else you will lose your right to a hearing.
